In the first episode of the rebooted series, Matt Murdock (Charlie Cox), Karen Page (Deborah Ann Wall), and Foggy Nelson (Elden Henson) are celebrating when a hitman shoots and kills Foggy.

The death of his best friend leads Murdock to assume his Daredevil persona, and he believes he kills the assailant, "Bullseye." Being tipped over the edge ultimately leads to Murdock putting away his vigilante role for good.
Despite the major death, fans have theorized that Foggy is not dead and is instead in witness protection. Deaths are never easy in the MCU, especially those that are permanent.
According to Cox, Foggy is 100 percent dead.

During a convention called La Conve Monterrey, Cox was one of the guests. When asked about the death of Foggy and whether he would return in the MCU, the "Daredevil" actor announced a sad reality regarding the character.
“Daredevil heard his heart stop. He’s dead. I’m sorry. I’m very sad. I am. I love that theory, but it’s wrong," Cox said.

Cox has shot down the theory that Foggy might still be alive, much to the chagrin of fans who were hoping to see Matt Murdock's best friend somehow be alive. Though this is a sad development, Cox has been wrong before.
Ahead of the second season, Cox spoke at another convention, stating that he believed the "Daredevil" series would be over after the second season. That was not the case, as it was later announced by Brad Winderbaum, head of streaming, television, and animation at Marvel Studios, that a third season would happen.
Cox might be attempting to throw fans off a big reveal in the MCU, which would be that Foggy is alive and well. However, he might also be trying to soften the blow when fans find out his words are concrete.
"Daredevil: Born Again" Season 2 is set for a March 2026 release, and it could be revealed then that Foggy is not dead. However, it might also not be that shocking if the season comes and goes, and the character does not return.
